By accessing or using ETF Overlap Checker at etf-checker.org (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. The Service is operated by Carraway & Gatsby Corporation (“CG Corp,” “we,” “us”).

2. Description of the Service

ETF Overlap Checker is a free, publicly available tool that compares the holdings of exchange-traded funds (ETFs) to identify overlapping positions. The Service uses publicly available fund data from third-party financial data providers and presents analysis for informational and educational purposes.

11. Limitation of Liability

To the maximum extent permitted by applicable law, CG Corp and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, investment returns, or goodwill — arising from or related to your use of or inability to use the Service, regardless of the theory of liability.

In no event shall our total liability exceed the greater of $100 USD or the amount you paid us (if any) in the 12 months preceding the claim.

You expressly acknowledge that any investment decisions you make based on information from the Service are made at your own risk.

12. Indemnification

You agree to indemnify and hold harmless CG Corp from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising out of or related to your violation of these Terms or your use of the Service.

13. Modifications to Terms

We may revise these Terms at any time by posting an updated version on this page. Changes are effective when posted. Your continued use of the Service after changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

14. Termination

We may suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service. These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
